Terms of Use

These terms apply to free software that I, Björn Kindler (Kindler Dev), make available for direct download through kindler-dev.de. Separate terms presented with a particular app take precedence for that app.

1. Free licence to use the software

I grant you a non-exclusive, non-transferable right to install and use the software for private or professional purposes. You may install it on Macs that you own or control. The software is provided free of charge.

2. Restrictions

You may not sell, rent, sublicense, or distribute modified versions of the software without my prior permission. Statutory rights, including rights that cannot legally be restricted, remain unaffected.

3. Ownership

The software, its name, design, and accompanying materials remain protected by applicable copyright and other intellectual property laws. These terms grant a right to use the software, not ownership of it.

4. Availability and updates

I may improve, update, change, or discontinue free software. I do not promise permanent availability, continued compatibility with future operating-system versions, or a particular update schedule.

5. Your responsibility

You are responsible for checking whether the software is suitable for your intended use and for maintaining appropriate backups. Permissions requested by an app are explained on its product page or inside the app.

6. Liability

Liability is governed by German law. Nothing in these terms excludes or limits liability where exclusion or limitation is not legally permitted, including liability for intent, gross negligence, injury to life, body or health, fraudulently concealed defects, guarantees, or mandatory product-liability rules. For free software, any further liability is limited to the extent permitted by law.

7. Privacy

Information about personal-data processing is available in the Privacy Policy.

8. Applicable law

German law applies. If you are a consumer, mandatory protections of the law of your country of residence and your statutory place of jurisdiction remain unaffected.
